Magdalena Avila

Senior Associate Attorney

Magdalena was born and raised in El Paso, Texas.  She graduated from Del Valle High School as the first graduating class in 1990.  She is one of three siblings, with an older sister and a twin brother. She graduated from The University of El Paso with a Bachelor's Degree in Criminal Justice.  Her first experience with the legal field came while she was attending the University of Texas and began to work for a high profile criminal defense attorney. She immediately became fascinated with the criminal trial process.  Although she quickly knew she wanted to be in the legal field, she was not quite sure how or in what area she would be part of the legal profession.  After her experience with the criminal defense firm, she was trained as a Paralegal for a Personal Injury attorney in the El Paso area. That is when her love and passion for personal injury law began. During this time, she realized how many people suffer injuries, even death through no fault of their own.  Whether it was a car accident, and on the job injury or a slip and fall injury case, she saw how unfair the insurance companies were and how much peoples’ lives change after suffering an injury.  There are so many people who are affected when they or someone they love suffer an injury or death due to someone else’s negligence.  These people are left with their world turned upside down, suffering from pain and recovering from injuries and often times do not know where to get help or where to begin to get the insurance company to be fair with them and put them back to the position they were before the incident. It was here that she realized she could make a difference. After obtaining her Bachelor's Degree she had the opportunity to work for an insurance defense litigation firm.  This gave her insight as to how both sides of casework. Although she learned a lot of how the defense side works, she knew she needed to be there for the other side. After two years of working in defense litigation, she decided it was time to go to law school. She made the move from El Paso to Houston in the Summer of 1997.  In August of 2000, Magdalena obtained her J.D. Degree from Texas Southern University in Houston, Texas.  She became licensed to practice law In May of 2001. At that time, she had done worked as a law clerk in Houston and fell in love with that city.  At that time, she also had job opportunities back in her hometown of El Paso. At some point, she even considered accepting a position with the El Paso District Attorney’s office.  Had it not been for her college sweetheart starting his career in the DFW area, she would have stayed in Houston or in El Paso.  Either way, she knew she would stay in Texas. Marriage took her to the DFW area and she settled in the Arlington area and began to work as an associate attorney for a personal injury firm.  Upon getting licensed she immediately began getting courtroom experience. She worked with family law, criminal defense, and personal injury. Within the first year of getting her license to practice law, she had participated in at least 10 personal injury trials.  It was at this time that she decided to focus primarily on the personal injury field.  Since then she has dedicated her career to helping those who have been injured have died as a result of someone else’s fault. She has been fighting insurance companies to get what her clients deserve for 18 years.  As a Personal Injury Attorney, she has collected millions of dollars in settlements for her clients. She has successfully litigated many cases and obtained favorable jury verdicts in her favor. She has litigated wrongful death cases and has handled many cases involving catastrophic injuries as well. No case is too small or too big for her. She has the experience necessary to take a case all the way. She is also admitted to practice in the United States District Courts - Southern and Northern Districts of Texas. She has been a part of legal teams in cases involving governmental entities. She has been to Washington D.C. many times to meet with Congressmen regarding pending legislation that she knows may impact her clients.  She has litigated cases throughout the state of Texas. She has the compassion and determination to ensure that her clients get justice and be compensated fairly for their losses.

Magdalena is a single mother of two children who are now in High School. She dedicates her time to her children and to her work. She is fluent in Spanish and takes the time to know each of her clients.  She works hard to obtain the maximum recovery possible for every client.

She had learned to manage her time at the office while at the same time dedicating the time needed to raise her children. This has proven difficult at times due to the magnitude of some of the cases she has handled. She has reached the balance needed to have a successful career while still being present and involved with her children and within the community. She does everything possible to teach her kids how important work ethic is and instill in them fairness in all of life situations. Doing what is right is what she believes in and practices this every day as she fights for insurance companies to do what is right.  Many times this is a stressful and emotional time for her clients so she does her best to keep her clients informed and always do what is best for the client.
