feel like at this time like Cody I’m so glad the each acre each year on July 13th many people participate actual french fry day by enjoy a variety of classes okay we’re gonna try and guess which one than they are there’s a whole lot of backstory about national French Friday but we all know what french fries are so we’re just gonna jump right into it so everybody pick up the wine Morris we’ll just go like this and then well we taste one I wanted Donald’s sonic jack-in-the-box and Eric me
look at these these are they bigger fries I feel like that’s very queen no wait that’s jackaboy so the the big fat fries punches it back down home fries just a fatter either too salty okay so the a salty with a grease yeah see tastes like McDonald’s but better let’s find out [Music] yes Wow which ones are your favorites I would say of course McDonald right where the Dairy Queen but they’re they’re pretty similar all right well thank you guys for joining you and you will continue on with the actual equal
portion of today but first some very exciting news for Fort Worth public libraries you can now check out a hot spot device you can break the Internet to your house for 3 weeks at a time so if you are in the Fort Worth area go to the library and check out the house I assume that there’s women number of them but because the Internet is so important and you have a contract and hard to get internet and not everyone can afford it the library has the hot spots so which is a nice alternative and it should help
students who don’t officially have a house so if you have questions about that just call the Fort Worth Public Library and I’m sure they have a person designated to handle this thing all right on to discovery and and what it is and what it means for your kids to make sure what is discovering change of information between two parties in a litigation in other words I’m suing you I’m gonna ask you questions that you’re gonna ask me why I’m suing you so we submit your case to a court there are rules of
procedures that you have to abide by in order to get a ruling from the court so one thing that we get a lot of pushback on is discovery because you’re like oh I have to get that information well because you submitted it to the court and you want them to make a determination for you it was in place to do that so there are several types of discovery we will just talk about two areas today written discovery and depositions so what types of good discovery whether there’s disclosures admissions
interrogatories in production and they are written answers to the other side basically they ask you questions and you answer them disclosures are standard the state of Texas and the Texas Civil Procedure rules say these are the questions we need answers to and every part each part isn’t talking to them you answer those they’re there in the procedure rules itself and then the others whatever the attorney on the other side thinks is appropriate to ask they send it over to be posing party or
attorneys office and you answer them you put in your objections explaining why you don’t want to get particular information and sometimes they’re entitled with the information other times they’re not there is by court and judge yes and what you brought your case for you know like if I’m suing you for personal injury there’s a set of questions I can ask you I’m suing you for breach of contract the personal injury questions may or may not apply and family law pretty much everything
it’s turned over to the other side it’s either divorce or custody issues generally and so admissions are like true/false questions yes interrogatories are open-ended questions that are technically undergoes production is requesting actual documents or physicals items and the disclosures are set out by the same so what is a deposition is where one party sits down with the other party and asks question to another person basically so but it’s a formal set it is formal setting this reporter
presently most of the attorneys are present the witness who’s being deposed is going to be present and both parties themselves are entitled to be present [Music] helpful for them or if they need someone there to fact-check as they go so these would be video recorders yes they can do videotapes and there always be a court reporter who will transcribe everything that’s said in that room by anybody I would let you know it is very interesting to read your own word yes sorry but it does help corrects the yep and it
is under it is subject to the penalties of perjury as it is which can be a criminal offense yes the prosecutor’s office picks it up so we prepare everyone for any times right so for written discovery you have them come into our office once we get the questions from the other side and we do this whole sit down talk about every question make sure we answer the question fully get all the answers have them sign the papers they need a sign for the purposes for answering the questions on them for deposition we do
something similar and we run through the questions that we anticipate the other attorneys and ask them can’t anticipate each and every question but the areas and topics that will be discussed and the documentation that may be subject to deposition so yes both of them at least I ask for a written discovery hour-and-a-half is what I scheduled and then for oral deposition I say two but sometimes we go over sometimes or under it just depends on the case and if it’s a particularly complex case there will
be multiple sessions for deposition preparation and or it can go for five hours yes but under the rules of civil procedure depending on what type of case it is and what level of discovery it is you have certain hours that the other side is entitled to so sometimes they use all of them we want case ups in it and there’s sometimes they don’t so we see you the same or similar question cases yes then we’ll get something exciting like generally good questions are very similar and how did this happen
what happened after how did this affect your life and what were you like before yep paper law is give me all of your information required to tell the truth yes if you do not tell the truth what can happen perjury perjury they said that’s potentially jail does it happen highly unlikely you you say your date of birth or we’re going to come after you and you get to you give a chance to correct your answers if by accident you say that you’re being a birth wall they’ll send the transcript over they’ll
give you a time period to make any changes and sign your transcripts and all of that stuff so you do get to change your testimony in case you you know just went out on the right mind that day and decided – exactly so you have to answer the questions and give the information but we also get to get the information and ask questions from the other side yes we get to ask but it’s both sides we get to depose the other party as well ask the questions their attorney also has the right to objective sort of privileges and we go
from there and they too have the right to change their testimony by changing it on the piece of paper that they get good language those cases settled pretty quickly if it’s a personal injury case all right so what happens a client just doesn’t want to participate then the court will make them participate or they lose or they lose yes if they don’t participate there’s not a case to be in front of the jury so remember you are bringing your case before the court and in doing that you have to follow the rules
you don’t want to follow the rules that you cannot bring your case in front of the court so you can elect to attempt to resolve it outside of court yeah my mediation or otherwise good luck yep the court can compel you to deposition and if you don’t show up again if you are [Music] [Music] [Music] this part in the middle is the contingent and not a lot of people understand this we have to sit down and explain both parts of it when we do our written discovery for so that you know what’s coming next did
