[Music] [Music] Friday Facebook in YouTube and welcome welcome to disclosure live with brandy Houston law I’m Heather Jamison and today I have with me 3x 4x today is September 7th on today’s episode we’re going to discuss the state planning 101 but first we always like to kind of cover a few things and within a local news so today is actually National Food Bank day and the first Friday in September is usually recognized annually across the country is national food bank made to bring awareness to the struggle

that struggle that the family have when it comes to providing food for their household so and usually the best way to 500 I know I personally go ahead and donate items then you can also go to the local food bank and and volunteer and there’s several different things that you’re able to kind of do to help you know go and fight the hunger against you and say I know what you’ve been hungry so that’s something today ok in on Sunday national national Sicilian week on Sunday national assist in the week

begins this coming week for advances assisted living communities that have a way for seniors who want an independent lifestyle when we still need assistance were there for their independent lifestyle oh sorry they still need assistance for their oh I was driving by sorry for their individual need in assisted living communities it’s a priority that recipients feel like they’re living independently while still driving the peace of mind knowing that their specific daily needs are met if you have

know I used to actually go into the local library and read smaller kids books with all technology and stuff like that it’s amazing that there’s to live that long one and you know kind of companionship that you get with bring it to the young kids and their imaginations it’s sort it be a part of that so that’s always fun so go out and get your library card today and the University of North Texas partners with lift hits up students of the University of North Texas the there’s a spring with Vinton

County Transportation Authority inland for X students with safe and reliable on-demand transportation transportation after hours the pilot program initially served current mmunity students in a dissipated area specified by the university also called the UNT lift zone for the hours between 2 a.m. and 7 a.m. each day and the program will run from August 17 through December 15th so keep that in mind when you’re out late it’s something that you also want to kind of worn and everybody that knows and knows

I kind of work in the department as I kind of call it so it’s within the probate estates guardianship and so I deal with elderly but and I have notices there’s actually an epidemic that’s going usually it has started a little bit earlier and usually I know isn’t it usually November December into January is when I’ve noticed it but there are checks that are being delivered and to people and unfortunately it is a scam and so if you’re not expecting a check almost 200 but not to go cash that check

because basically it’s a way that the wiring transfers they get into your accounts and they’re not just focusing on elderly and I’ve also know people that young people like yourself and and you know this average day to day people are being affected by this so if you definitely get some sort of check or something like that in the Manawatu year routing or account number please do not do it if you do contact an attorney’s office we can assist but no place that we’re going to do is we’re going to go ahead

and go to today’s topic today we’re going to discuss just kind of some estate planning 101 I’m just some simple things that we’ve been touching bases on trust and you know probate that our ninja tips that learn it’s going to go ahead and kind of get with some basis okay so what we’re going to start off with what is the dual power of attorney with a durable power of attorney it the best way that I’d like to kind of describe it to quiets are people that are looking to kind of see as to what it

is it’s it’s a document in which you authorize someone to be able to take care of actually needs so with the durable power trim there’s several different types and ways that you can actually execute it the most comment basically is where you can kind of go in and do it upon your a capacitation dealing with elderly I always say once you a kind percent trust that person because this is someone that can get into your bank your financials your 401k your life insurance policies like this

this document is a very powerful document and so you don’t just want to give it just anybody unless you just hand them your bank accounts they know everything so again it’s just it’s just kind of appointing an agent where in the event whether it be temporary business related personal related and have someone kind of oversee your finances okay and what is the medical power of attorney medical power of attorney opposite of financial instrument all decisions so I know most people are usually familiar when they go into the

hospital they always ask if you have a medical power of attorney you know HIPAA and then a directive to position and but medical power of attorney basically it’s just you know get in there and do you know be able to make those medical decisions in the event if something was happening you’ve been it’s being an accident and you can do those also temporary or you can do a lot of time as well and also those aren’t are those just for elderly people or in this job and it is for yeah for

people with enemies yourself and it could be it literally it’s anyone and I’ve been my grandparents since I was 18 just because you know having that sound person and medical care attorney also and it with and we’ll talk about hip in a second but and but medical there are different disclosures that you can’t do so and I know in my personal situation I was taking my grandfather to the doctor all the time and even though they saw my face and I was a little men in the consults and stuff it got to the point

where basically they wouldn’t give me any information even when said an appointment unless I had that medical power of attorney so so it just kind of depends on that how how extent that you want somebody involvement and having that it is an authorization we’re not just the doctors hospitals anybody else can give you information itself and I noticed saying you did mention a HIPPA it is just a healthcare release and medical power of attorney and a lot of people think that it’s because they have

that medical power of attorney that they have the authorization to obtain medical records and that’s our case you know and some facilities do allow it however a HIPAA it’s completely separate because there’s different types of medical records that you can kind of obtain and you can look personal injury we kind of know and and so there’s different things that you can grant that person and even the ability to kind of disclose and get those records but and ultimately it’s I would say medical regular the side that

the medical decisions is medical power of attorney okay and then how do I go about my daily donor or yes yes and what that is is basically and if you wish to be a donor organs and different things of that nature there are specifics that you have to do and you can’t just say I can’t just say you hey I wish that my eyes be donated to science and then hope that you basically want to pass and have that happen because there are different things that you do have to do and there are organizations out there that you can

get in contact with they have their own specific forms and estate planning is one of the biggest things because not just what your will but again having these forms you’re going to have to have them in place in order for your wishes to be followed through so and so there’s definitely different things that if you’re interested in it and I always will definitely contact those first day planning but I don’t seek the advice of an attorney is basically there it’s your body and then when she passed away there’s family

there’s different things you know they can come into play without so so what about a cremation and guru requests within there that the biggest thing it only takes one person to contest the fact and then you no longer want to actually – and that you don’t actually want to be but you know cremated and so what you can do cremation unlike anatomical gifts you know they have forms and a theme you know places that kind of present what your wishes are and when it comes to cremation there’s not

anything that’s kind of step right there so the number one thing when you basically raft your will and when it has in there is religious beliefs you can put a bear and request but it is it happens mandated that if you wish to be cremated it has to be listed within your will that way shows what your intent warrant was and when executing a will by an attorney and kind of by the statuary standards you have to have an ovarian to witnesses so if it ever comes to be that you know a family member says no that’s

not what their wishes were you have this document that was witness notarized says yes this is what I wish to do and the same thing as far as with very little barrel requests aren’t aren’t as straight you know when it comes to that some people do plan and at a time and which burial and their service are two separate things because some people wish to actually have whether it be a Christian service or no service within their burial and they have their plots are going to pick down and everything’s

back teacher so it’s part of the estate for any process event something I know nobody really wants to invest it but it is something that it’s a lot better this is going to get it out there yeah in a nice bonus that you mentioned a little bit about the religious beliefs yes she’s an attorney here and she always had and you know and I think kids yeah with her religious believes they believe that you know that they want to be cremated so that’s one of the biggest things that you know what she does what

should be cremated it does have to be listed and of course with your family growing up you think you know fit your religious belief they’re going to do what they what you want them to do however legally it mistakes that one person who came to say no and then they can’t do anything so so whether it’s religious based or just personal beliefs and definitely do something within a near state level so and what is Indian art that’s my favorite PNR it has several different titles I guess you can

say and the NR is basically do not resuscitate and I get a lot of calls with of course we did with trust and so I get calls saying why we want a living trust and then once I start explaining things and they’re like well no I don’t want that I want the thing where I don’t want to be a last quarter so basically what the director to position is is it’s your specific directions as to whether or not you want to be on life support and there’s we we personally Miss Austen drafts where

there’s two separate ones and ones you know kind of different types of incapacitation but and you can also go get more in depth with the DNR and as far as you know to bull feeding you know artificial that there’s so many different things that you can actually kind of get in there and do but one of the other biggest things that I get a lot of questions about is if they’ve executed a medical power of attorney that they this person knows what I want and what if I do the CNR and a lot of

people honestly don’t do at the NRA’s because of religious beliefs and they do feel that if they take that control you know happens but basically the way you have a DNR in place and you’ve executed that need are your medical power of attorney agent has to abide by your decision so so that’s always something to you and because it’s kind of a 50/50 within state training and there’s some people that don’t want to execute it and but then I have some that want to because they don’t want their children

to have to make that decision so that’s one thing even if you put it you know saying that your parents put you down as your medical and they decide that they don’t want to be on life support you have to follow their decision so you’re not the one that else will be making that decision and having your siblings so tell me more about a declaration of guardian and what is it and what types are their estate money-wise and the most common and especially if I would slowly do of course declaration with guardian with

elderly and it’s more so in the event as far as a capacitation and while you’re still of sound mind you’re able to declare to the courts as who you would want to take care of you and usually we’ve touched the basis on a little bit and if you have a trust that’s in place usually you’ll never have to worry about having to apply for guardianship over somebody because there’s two types but basically what that declaration of guardian is if it gets in there and lets you know you know I hate this is I want

this person handle my finances this person’s been handled and my medical decisions and but there is another section – for minor children because you can declare a guardian or your children and in mr. van Clarion nineties a family law attorney we have kind of talked about the – and of course while there’s have more additional rights as let’s say the bomb was going to pass and it is a little bit different we’ll probably get in and kind of do a little bit more and discussion about that but those are usually the two types
