New Updates To Medical Coverage Of Child Support

and she is working as far as within the family law department and then also our probate elder and garbage department so she’s definitely new so everybody can kind of see as far as our old fears to be able to you know current cases stuff like that she’s going to be working on some of the cases but definitely feel free to come by and stop by and say hello and welcome her to the law firm but first what we’re going to do and like I said today on today’s episode we’re going to discuss some of the

recent changes to the medical and chocolate child’s medical support and insurance coverage so the first we’re going to go through this kind of touch bases on a few little fun things that are happening in some of the local news story today is a national beach thing but everybody loves a good day at the beach and yesterday was national beach day actually so the holiday began in 2014 to pay homage to the beauty of the beach while also and call an attention to keeping them clean and safe so by

simply cleaning up you reduce the risk of animals getting trapped and tangling in trash and unless of the chance for their homes to be destroyed so firmly buried getting out there and doing your part and picking up some trash so what’s our next little topic for next we’ll talk things about college color day I don’t know it all but I’m really excited for football season so today it’s national college colors day crichton poorly written all across the u.s. we see students parents family everybody

coming together to display her their to their school spirit so you’re out there to get open wearing your college spirit colors also and one of my favorites I always say be human and today is be kind to humankind week so the last week or this last week is be kind of humankind week and this is an annual celebration and was kindness recognized globally from August 25th to 31st each and every day of the year and the entire week celebrates each day specifically guiding people on how they should be a kinder

human beings during that day or that week basically some things as far as sacrificing our wants for other needs on Sunday a risk consideration on Monday Tuesday and willing to lend a hand Wednesday’s thoughtful Thursday and forgive your fellow Friday and then of course weeknights worms on Saturday all right we got some good local news about six live there’s the Nemo coaster coming yes I know we’re all thinking summers down schools back in session just yeah I’m not done yet so no I know there’s a ton of

construction at the down 34:6 live but only to go check it out world’s largest loop roller coaster today big news for texting although everything’s bigger in Texas so I’m going to surprise so that any Lone Star revolution roll code is gonna be swinging like a pendulum takes riders back and forth on that leap it goes a full 360 revolution oh I’m a little bit scared what’s going on to this topic so basically today we’re going to discuss recent changes in child medical support for dental insurance

coverage so we’ll go ahead and kind of start with and ask you some questions basically what is medical support in Texas okay so in Texas y’all we’re all familiar in child support now that is a big part of what Texas law has in place one of the things a lot of people may not know about is that support is included in that generally what we see happening is that parent paying the child support if they can have the child or children onto their coverage at a reasonable cost the state says

reasonable is no more than nine percent of that that income that we’re looking at then that parent can go ahead and add into their insurance if the parent paying child support can’t afford to do that they’ll be obligated to reimburse the parent receiving that child support for that medical amount so that meant it was before y’all keep in mind that is something that’s included in child support in the state of Texas it’s something that y’all can reach you as well you want to be sure to make sure

that there’s still need their state guidelines and requirements and presented back to a judge but the medical support is absolutely included in insurance that’s part of child support nowadays you also this is the new change back in 2015 turmeric first legislation passing laws regarding dental insurance this upcoming September of 2018 is when we get to see it going to effect so we’re really excited about that I don’t know about chocolate I had races going out tonight every parent uses uses dental insurance when

they can and when they meet you so with these new laws that dental insurance is going to be added into that medical support states gonna die state guidelines excuse me to accommodate that kind of the same way again not caring that’s paying child support can add them and how the children put on their dental insurance again that reasonable amount is looked at a little bit differently more like 1.5 percent again it’s that parent paying the child support can’t do that with a reasonable cost they can go

ahead and read verse up here receiving the child support so big changes we’re really happy about it it’s something that we are going to do for you keep in mind well if you have something that was decided before September 1st 2018 this law it’s not going to affect you unless you choose to modify the order that was issued before those retroactive as far as more attractive and modification had that’s a little bit different as far as it’s a modification basically what a modification is if you have that

standing order and then say changing circumstance means in you are able to go back to work get that modification and get that order and then so at that point what would be and just like Heather said we’re modifying that order after September 1st 2018 so after tomorrow then these new laws are going to be taken into effect so keep in mind well if you having hearing dates that with the judge when you’re looking to modify go ahead and ask that judge to include dental insurance as well now if

you’re filing originally after September 1st the courts are going to be considering that Avenue a part of your case but again keep in mind for those modifications even if you got an order you know a few years ago with a look at me when I’m flying this next year that isn’t it yes so basically how is this calculated within a regular tops work because we’re sure we’re going to get asked questions and say the person has to pay $500 a month or child support and that’s a great question I think that’s

something we all want to look at when you’re making those support obligations we’re looking at it holistically and so with that amount that we see coming out for child support and then those supports are going to assess that medical and dental amount and out of that law what we often see and you know we never take advantage Tufts here there’s a couple ways that we do this calculation depending on where you’re seeing those insurance tactics it will receive it as it’s through the state we’re gonna get

those calculations based on premium amount for the person receiving those benefits again that parent that is paying out that support is going to be obligated to pay that state guideline if we have it through private insurance or employer then we’re going to look at what that premium amount that the parent has the children or their insurance is paying best practice investing if you are the parent pay have support go ahead and see if you can add the children on to your dental and health insurance if

you have been keeping money which is reimburse the other parent in order paying for their support obligations but to ensure that they have a method then needs to get that insurance now courts are are aware some of us don’t have insurance that there are folks out there that talk in situations like that that working order a cash son to be added as part of your child support that accounts for some of those medical expenses so again you know we see the quirks calculating this based on let’s

determine as reasonable for what you’re earning and again that that nine percent for medical and about 1.5 percent are so for dental and the quick is gonna wrap that all up into your child support you’re gonna look at that as one song and it’s all broken out so you see exactly what’s coming from where but that’s essentially how the court believes those basically does Medicaid cap as medical insurance yes it does like we were just talking about well that’s one of those methods

that a lot of us do get benefits from the state no again if that’s the case and you’re the Parisienne child support you have the children on Medicaid through you you’re gonna get that reimbursement from the other parent pain and that’s gonna be based on the premium you’re paying for through the state and that reimbursement comes as such so definitely Medicaid is included now Medicaid and dental insurance going into Han that’s always been part of the law what’s being changed now is that dental

insurance for private as well and I would’ve you aware as far as Medicaid of its own one of the biggest thing was chips you know they do know as far as chips which chips would fall under the same category correct if the family was caring for it so that’s something we want to keep in mind when we’re looking at the calculations with this and all that the court is going to consider it look at the incomes of everyone where we get into some of those state benefits and how does that finish the thing with

no guidelines for what your support obligations are going to be and so what about all the things that paying for out of pocket and like very much as my deductible is high what do we do with that we’re gonna mean it and always going out of pocket that is also something the courts can consider and something that can be very applying what we often see is that what we call unreimbursed medical expenses the courts can fit certain guidelines in place now the thing that generally happens is 50 percentage split between the two parents

for everything unreimbursed so all of those kind of pocket expenses that we see for orthodontics works for prescriptions for doctor’s visits and so forth big thing to remember with unreimbursed amounts the courts generally are going to put some two for limitations in place they’re gonna say things like you have 15 to 30 days from of the receipt of warning words for that benefit payment to request the other parent to reimburse you and you want to be sure when you’re getting their supporters and making that request that

you look at what the judge mandated it’s a judge says you’re entitled to fifty percent reimbursement for those out-of-pocket expenses be sure that you read the full language to see that your entitlement is based on your duty to ask the other parent within a certain time frame that parent is to pay you back within a certain time frame but the biggest thing people miss is that a lot of courts will put in a 15-day requirement that 30-day requirement and you want to be going through the feeders

well and some courts will require that that certified mail really want to be sure the grounds in the court be sure that in mind that those additional steps that they were are going to take to make sure you never see those benefits well it definitely didn’t want to say happy Friday and both Nguyen starch to the firm and it’s kind of a little quick shout out also and tomorrow is our firm owners birthday so everybody feel creative and either tipsy vanilla Brady another happy birthday she’s 21 again but alright that’s
