good afternoon Facebook followers welcome to this week’s edition of I guess we’re going to call it 10 minutes with a lawyer um we’ve gotten several questions it’s still family law month and we’ve gotten several questions about child support but we thought we’d shake things up a little bit and we’re going to do a Texas legal analysis of a portion of Kanye West gold Dicker so we’ll have someone read the lyrics and then we’ll talk about uh certain sections 18 years 18 years she got one
of your kids got you for 18 years in actuality it could be longer isn’t that right Larry that is right uh but before we even get to that the one thing that you have to do is first prove that the child is yours uh if if you guys are married then there’s a presumption the child is yours uh but if you’ve signed an acknowledgement of paternity or if you have genetic testing then uh that’s when they can go and and start to take the child support out uh when when the child is 18 a lot of people think that that’s
when child child support ends but you also have to understand your child needs to graduate high school as well so either it’s 18 or they graduate high school whichever comes later and if the child is uh disabled then child support payments can go on indefinitely so Kanye was right in some aspects but it could be longer could be longer I know somebody paying child support for one of his kids his baby mama’s car and crib is bigger than his well in Texas that’s not always true right yeah that’s not that’s not always
true I mean I guess the best way to think about it is uh child support is supposed to be used for the support of the child so uh you have to think of what’s in the best interest of the child the things that your child needs um what they need to be taken care of we’re not talking about the bare necessities of life I mean the court takes a lot of fa in play when it comes to taking care of your child but even then if I go off on a personal aspect It’s Your Child So if your child lives in a better place and has better
things than you do I mean that’s what we as adults and and parents want to do we want to have things that are better than us so that we can provide for our kids so I mean at the day at the end of the day as long as your child’s taken care of that’s what child sport is for and it’s limited I mean in Texas the Court’s not going to just say they have you 20% of everything there’s a cap if you know it’s cap is 1500 isn’t that right the, 1500 didn’t move up moves up every
year I think it moves up every year so uh there’s a limit and you have to petition the court for more so it’s not always going to be you know if you’re making $2 million a year you’re not going to have to always pay 20% of that I mean 40% to taxes let’s start there but after that you’re not going to have to pay just 20% flat out you know there’s additional things that need be shown to the court in order to get it more than you know the cap in Texas so it it’s kind of right but not
necessarily the same as I’m sure California is what they were talking about when he wrote the song you will see him on TV Any Given Sunday win the Super Bowl and drive off in a Hyundai well you know he could like his Hyundai uh but also that could just be money management skills because again it’s not the same in Texas and and I actually you know based on that lyric I actually work some numbers so I don’t know if if these are the right numbers as far as NFL salaries but you know NFL
minimum for a rookie is 450,000 a Super Bowl bonus is around $90,000 so Texas is you know 20% so let’s just for Simplicity sake say yes we’re going to just take 20% of that so we’re talking about 9,000 a month for child support that’s about 108,000 a total year for that just that child support but if we’re talking about um monthly that still leaves around $36,000 for that NFL player to survive off of so I mean if he wants a better car he can get it but I think more than likely he needs to get a financial plan
that’s true probably poor money management yeah she was supposed to buy shorty Tao with your money she went to the doctor and got lipo with your money she was walking around looking like Michael with your money should have got that insured got Geico with your money well there’s a couple of things in that one which Michael do you think they’re talking about I think Michael Jackson he was he was rumored to have several plastic surgeries rumored we we don’t confirm nor deny um okay so tell me Larry big
question that that we get a lot of times can you control what the mom spends the child support money on no no you can’t control it I’ve even heard of people even saying hey there should be like this top up card that sends the father financial statements on what it’s purchased I mean that’s just not going to happen now I think maybe they may have some type of cause of action if you know the child’s needs aren’t being met if they can prove that and and let’s say for instance you know mom is getting a
whole bunch of lipos suction I think it’s going to be very difficult to prove in court but if they’re able to then they may be able to get a reduction um but other than that you know that you can’t control what the mother spends the child support money for and chances are if she’s you know spending money on lipo she’s probably spending money on the child and making sure it’s dressed to her standards yeah oh but then there’s a second part about Geico Geico insurance can you ensure yourself for child
support great question Kanye no you can’t uh and I think you would look really foolish if you call Geico asking to ensure you for child support uh I know they ensure a lot of things but child support isn’t one of them I the if I may the best insurance is is abstinence if you don’t want to pay child support is there a secondary option uh Trojans lifestyle durx those are secondary options all right 99% effective if used properly if you ain’t no punk holler we want prenut we want PR up it’s something that
you need to have because when she leaves you she’s going to leave with half well great advice Kanye and we do uh do prenups here Larry what do you think yeah I think I think that’s a great slogan you know if you’re NFL football player and you’re making a lot of money you you maybe should get a prenup even if you you know you’re just a regular person if you want to do prenup um then get a prenup but that that only applies to property uh things like uh spousal maintenance or normally refer to things
of that nature if you try to do a prenup regarding child support it’s not going to fly the court looks at the best interest of a child and they will not enforce something that is adversely affecting the child’s rights so preup for a child support not going to happen prenups are really good for couples to establish expectations and standards and things like that and you can put all sorts of things in a prenup but that’s for a different day and a different time 18 years years 18 years on her 18th
birthday he found out she wasn’t his and luckily Texas encourages DNA testing uh prior to start of Child Support isn’t that right yes and it goes back to the to the very first part about 18 years I think a smart individual if if you were in a relationship with someone that you just weren’t trustworthy about and they say hey this is your child uh the first thing you should do is is start paying child support um what I would advise you to do is to create a bank account and put those monies aside just in case but get the
