In Texas law, forgery means the act of altering, making, completing, executing, or authenticating any writing so that it appears to:  1) be the act of another person who did not authorize this act; 2) have been executed at a time or place or in a numbered sequence other than was in fact the case; or 3) be a copy of an original when no such original existed.  Forgery also means the issuance, transfer, register the transfer of, pass, publish, or otherwise utter a writing.  Finally, forgery also means the possession of a writing that is forged within the definition given above with the intent to issue, transfer, register the transfer of, pass, or publish the writing.

A person commits the offense of forgery if he or she forges a writing with the intent to defraud or harm another.  Forgery is a state jail felony if the forged document purports to be a will, codicil, deed, deed of trust, mortgage, security instrument, security agreement, credit card, check, authorization to debit an account at a financial institution, or similar sight order for payment of money, contract, release, or other commercial instrument.  Forgery is a Class A misdemeanor for any other document.  If at trial it is shown that the offense was committed against an elderly person, punishment is increased to the next highest category of offense.
