The Texas Penal Code states that a person commits assault if the person intentionally, knowingly or recklessly causes bodily harm or threatens another with imminent bodily injury; or a person commits assault if the person intentionally or knowingly causes physical contact with another when the person knows or should reasonably believe that the other person will regard the contact as offensive or provocative.

Assault is a Class A misdemeanor unless the person assaulted is a public servant lawfully discharging an official duty, a person whose relationship with the defendant is defined in the Texas Family Code if the defendant has been previously convicted of an assault, or if the defendant intentionally, knowingly, or recklessly impedes the normal breathing or circulation of the person.  In those cases, assault is a third degree felony.

The penalty range for a class A misdemeanor is up to one year in jail, and/or a fine not to exceed $4,000.00.  The penalty range for a third degree felony is imprisonment for not less than two years, and not more than 10 years, plus a fine not exceeding $10,000.00.
